PRESS OFFICE TERMS OF USE

Section 1

1. Prepared in accordance with the laws of the Republic of Poland, these Terms of Use set out the scope and terms of use of the Cyfrowy Polsat Press Office, which is an integral part of the website www.cyfrowypolsat.pl.
2. Each prospective User must read these Terms of Use before using any functionalities available in the Press Office.
3. The contents of the Website are the property of Cyfrowy Polsat S.A. and are subject to intellectual property rights protection.

Section 2

Data Controller or Company means Cyfrowy Polsat S.A., with its registered office at ul. Łubinowa 4a, 03-878, Warsaw, Poland, entered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under No. KRS 0000010078, NIP 796-18-10-732, with a share capital of PLN 25,581,840.64, paid in full.

Press Office means the part of the Website enabling Users to obtain, also by downloading, graphics files and various press materials and information concerning the Company, to subscribe to the newsletter and to register participation in testing the Company’s products/equipment.

Terms of Use means this document, defining the rights and obligations of the Users and of the Data Controller.

Website means the website located at www.cyfrowypolsat.pl.

User means any individual having Internet access and full capacity to enter into legal transactions.

Section 3

1. Users may access the Press Office and download information and materials contained therein solely for personal use or in order to edit, create, prepare, publish and disseminate press, radio and television materials and to create content intended for publication on news websites, unless a broader scope of use has been expressly allowed in the Press Office with respect to a particular material.
2. Any materials downloaded from the Press Office which are disseminated by Users, including their own materials, must in each case contain the following note on the source: ‘Source: http://www.cyfrowypolsat.pl/biuro-prasowe/‘.
3. Any materials that are available from the Press Office may not be copied, displayed, published or otherwise disseminated in any manner other than specified above.
4. Downloaded materials may not be altered, modified, distributed, transmitted, reproduced, copied, published or used for own commercial or marketing purposes. Removal of any trademarks appearing in the texts and photographs sourced from the Press Office is prohibited.
5. Downloading by Users of any materials accessed through the Press Office, including but not limited to any photographs bearing the logotype of Cyfrowy Polsat S.A. and/or any trademarks owned by Cyfrowy Polsat S.A., is not equivalent to obtaining the right to use such logotypes or trademarks for the Users’ own purposes, particularly for the purposes of marking their own products and services.

 Section 4

1.Users may subscribe to the newsletter by means of an electronic subscription form available from the Press Office, in which they provide the following information:

a) User’s name and surname,
b) press affiliation,
c) email address,
d) mobile phone number,

give their consent to receive promotional materials (informacja handlowa) within the meaning of the Act on Provision of Services by Electronic Means of July 18th 2002, and confirm that they have read and agree to these Terms of Use. While giving consent to receive promotional materials is not obligatory, it is necessary for Users to be able to subscribe to the newsletter.
2. The newsletter is a service for providing Users, via electronic mail, with information on important events concerning the Company’s business, its products, and conferences organised by the Company, etc., as well as for delivering promotional materials within the meaning of the Act on Provision of Services by Electronic Means of July 18th 2002.
3. The frequency of newsletter deliveries is determined by the Press Office.

Section 5

The Press Office enables Users to register their participation in testing the Data Controller’s products/equipment. Users may register for testing the Data Controller’s products/equipment by means of an electronic form available from the Press Office, in which they provide the following information:

a) User’s name and surname,
b) press affiliation,
c) email address,
d) mobile phone number,

and confirm that they have read and agree to these Terms of Use.

Section 6

1. The following technical requirements apply to the use of the Press Office:

a) Internet access,
b) a web browser,
c) an active and properly configured email account.

2. Users may not submit any content that contravenes the law, including any illegal content.
3. The services available in the Press Office may be used free of charge. The costs of connecting to the Press Office are borne by Users according to the rates of the relevant telecommunications service provider.
4. The Website uses cookies, or text files that allow the Website’s servers to store information on the hard drive of the Users’ computers. The stored cookies do not change the configuration of the Users’ equipment or the software installed on the equipment. Users may disable cookies at any time by changing relevant settings in their web browsers, with a provision that this may prevent them from using the Website.

Section 7

1. The controller of the Users’ personal data is the Company, which processes such information in accordance with applicable laws, including without limitation the Act on Personal Data Protection of August 29th 1997.
2. Depending on the type of submitted application, the purpose of processing the Users’ personal data, as specified in Section 4.1 and Section 5, is to:
a) deliver the newsletter and promotional materials by electronic means within the meaning of the Act on Provision of Services by Electronic Means of July 18th 2002, or
b) enable the Company to arrange for the User’s participation in testing the Data Controller’s products/equipment,

and to enable the Company to fulfil its legitimate objectives.

3. Users may access and amend their personal data.
4. While providing personal data is not obligatory, it is necessary for the performance of a service.

Section 8

1. Users may at any time unsubscribe from the newsletter and withdraw their participation in testing the Company’s equipment/products by sending an email to biuroprasowe@cyfrowypolsat.pl.
2. The Data Controller may disable the newsletter service at any time, in which case the Controller is required to notify the Users of the same by sending an email to the respective email addresses provided by the Users.

Section 9

1. Complaints regarding the operation of the Press Office may be filed by Users to biuroprasowe@cyfrowypolsat.pl.
2. Any such complaint should:

a) contain the name and surname of the User,
b) specify the nature of the complaint,
c) specify the grounds for the complaint.

3. Complaints will be considered by the Data Controller within 14 days from their receipt.

Section 10

1. The Data Controller reserves the right to make changes to the Press Office and to modify its content at any time without prior notice.
2. The complete text of these Terms of Use is available to Users from the Press Office free of charge in a form that allows them to download, save and print a copy hereof.
3. The Data Controller reserves the right to amend these Terms of Use. The Data Controller must notify the Users of any such amendment, specifying its scope, at least 14 days in advance. If a User does not cease to use the Press Office within 14 days from receipt of the notification referred to in the preceding sentence, the amended Terms of Use will take effect and will become binding on the User upon the expiry of the period stated above.
